Rule 2207 Actions arising under foreign law

If someone dies because of another person's wrongful actions in another state or country, and the family wants to sue in Pennsylvania, they need to follow specific rules about who can file the lawsuit.

The person who files the lawsuit must be the same person that the other jurisdiction's laws say is allowed to file it. For example, if the death happened in New Jersey and New Jersey law says only the spouse can bring the wrongful death case, then only the spouse can file that case in Pennsylvania. Pennsylvania will not let a different person bring the case just because Pennsylvania's own rules might allow it.
