Rule 1126 Defects in Form, Content, or Procedure

Small mistakes in paperwork or court procedures will not automatically get a case thrown out or result in a child being released. The mistake has to actually matter.

To challenge a paperwork or procedural mistake, a party must speak up before the adjudicatory hearing begins. If they wait until after the hearing starts, they lose the right to raise that issue.

Even if someone does raise the issue in time, the judge will only act on it if the mistake actually hurt that party's rights in some real way. A minor error that did not affect the outcome or fairness of the case will not be enough to dismiss it.
