Rule 1 Sheriff to File Affidavits on Arrest

When someone is arrested, the sheriff or law enforcement officer has to turn in paperwork proving why the arrest happened. This includes the affidavit (a sworn written statement) and proof that the person was properly served or notified. This paperwork must go to the magistrate, who is a type of local judge.

The officer has five days from the date of arrest to file these documents. This keeps a record showing that the arrest had proper legal grounds and that everything was done correctly. It also helps make sure the court system has the right documentation on file early in the case.
