Rule 37 Dispositional Hearing

Here's a plain English summary of this rule:

The same judge who heard the facts of your case and decided what happened will usually be the one who decides the outcome or punishment. This means you won't have to explain your case to a new judge who doesn't already know the details.

There are a couple of exceptions to this. If Rule 33(b) applies to your situation, a different judge might handle the dispositional hearing. Also, if the original judge is unavailable for some reason, like being sick or no longer working on the case, another judge can step in to handle this part of the process.

The idea behind this rule is to keep things consistent and fair. The judge who already listened to the evidence and made findings is in the best position to decide what should happen next, since they already understand the full picture of the case.
