Rule 1 Reuse of Tapes Used to Record Proceedings

Probate courts in South Carolina often record hearings on tape. This rule explains when those tapes can be recorded over and reused instead of kept forever.

A tape can be reused in two situations. First, if someone has already made a full written transcript of what happened in the hearing, the court doesn't need to keep the original tape anymore. Second, even if no transcript was made, the court can reuse the tape once six months have passed since the final order in the case was issued.

For someone involved in a probate case, this means the recording of a hearing won't necessarily be kept forever. If you think you might need a copy of the recording or a transcript, it's best to request one before the six month window closes.
