If someone involved in a lawsuit becomes legally incompetent, meaning they can no longer make decisions or handle their own affairs, the case doesn't just stop. Someone can file a motion asking the court to let the case continue with a representative standing in for that person. This representative could be a guardian, conservator, or someone else legally authorized to act on their behalf.
The person asking the court to make this change has to notify the other people involved in the case the same way they would under Rule 25.01. This means proper notice has to go out before the court will make a decision.
Once the court approves the request, the lawsuit keeps moving forward, but the incompetent person's representative takes over their role in the case. This protects the incompetent person's rights and interests while still letting the legal process continue instead of grinding to a halt.
