Rule 502 Limitations on Waiver of Privileged Information or Work Product

If someone accidentally shares private legal information or work product during a case, that mistake does not automatically mean they lose their legal protection over it. This can happen, for example, if a lawyer accidentally hands over a confidential document during evidence exchange.

For this protection to apply, three things need to be true. First, the disclosure has to be a genuine accident, not something done on purpose. Second, the person or their lawyer must have taken reasonable care to keep the information private in the first place. Third, once they realize the mistake happened, they need to act quickly to fix it, like asking for the document back or telling the other side it was shared by mistake.

This rule exists so that one slip-up does not cost someone their right to keep sensitive legal information confidential. It gives people a fair chance to correct honest mistakes without being punished for them, as long as they were careful to begin with and acted fast once they noticed the error.
