Rule 123 Reversal of Judgment

If you win an appeal because the other party was never properly notified about the original lawsuit, the case does not start over from scratch. The court will not require anyone to be served with papers again.

Instead, the defendant is automatically considered to have shown up to court once the appeals court sends its mandate back to the lower court. This means the case can move forward without repeating the notification process.
