Rule 138 Cost of New Trials

When a judge orders a new trial, someone has to pay the court costs from the first trial. The judge gets to decide who pays those costs.

The judge can make the party who asked for and received the new trial pay those costs right away. Or the judge can wait and let the costs be handled at the end of the new trial, when the final winner and loser are decided.
