When someone dies while a lawsuit is still going on, the case does not automatically get thrown out. If the legal claim is the type that can continue after death, the case keeps moving forward.

Most types of civil cases can survive the death of a party. The court has a process for handling what happens next, such as substituting a surviving family member or the person's estate into the case.
