Rule 163 Dismissal as to Parties Served, Etc

If you are suing more than one person, you can drop one or more of them from the lawsuit. You can do this even if those people have already been served with court papers or have already responded to the lawsuit, as long as dropping them does not hurt the other parties involved.

There is one important limit. You cannot drop the main person who owes the debt or obligation you are suing over, unless a specific law allows it.
