Rule 240 Where Only Some Answer

When a lawsuit has multiple defendants, they don't all have to be at the same stage of the case at the same time. Some may have responded to the lawsuit while others have not.

If one or more defendants were properly served with the lawsuit but never responded, the court can issue a default judgment against just those defendants. The case against the other defendants can keep moving forward or be put on hold while this happens.
