Rule 28 Suits in Assumed Name

If a business uses a name that is not its official legal name, it can still go to court using that business name. For example, if a shop called "Joe's Hardware" is actually owned by a person named Robert Smith, the lawsuit can still be filed using "Joe's Hardware."

Either side in the case can ask the court to swap in the real legal name instead of the business name. The judge can also make that change on their own without anyone asking.
