Rule 638 Property Not to Be Designated

When a court orders someone to pay a debt, the person who owes money cannot choose which property gets taken to pay it off. Specifically, they cannot point to property they have already sold, mortgaged, or signed over to someone else.

They also cannot direct the court to take property that is legally protected from being seized to pay debts. Texas law protects certain property, like a family home or basic household items, from being taken this way. The person collecting the debt has the right to find valid property on their own.
