Rule 697 Petition

Before a court can issue a writ of sequestration, you must first file a petition with the court. A writ of sequestration is a court order that allows property to be seized and held while a lawsuit is ongoing.

This requirement applies to cases in both district courts and county courts. You follow the same steps you would use to start any other lawsuit in those courts. You cannot skip the petition and go straight to asking for the writ.
