Rule 728 Burden of Proof

When someone claims ownership of property that was taken by a court order, who has to prove their case depends on who had the property first.

If the property was taken away from the person now claiming it, the other side (the plaintiff who got the court order) has to prove they have the right to it. But if the property was taken from someone else, like the defendant or another person, then the one claiming ownership has to prove the property belongs to them.
