Art. 16.07 SAME RULES OF EVIDENCE AS ON FINAL TRIAL

When a judge holds an early hearing to decide if there's enough evidence to send a case to trial, the same evidence rules used in a full trial also apply here. This means the court can't be more relaxed or more strict about what counts as proof just because it's an earlier stage of the case.

In practice, this protects everyone involved. Prosecutors have to present evidence that would actually hold up in a real trial, not just weaker or looser evidence. Defendants get the same protections at this early hearing that they would get later, like rules about hearsay or how evidence must be gathered and presented.

So if something wouldn't be allowed as evidence at a full trial, it also can't be used at this earlier hearing to decide whether the case moves forward.
