Art. 55A.005 UNLAWFUL CARRYING OF HANDGUN

If you were arrested and convicted for unlawfully carrying a handgun, you may be able to get your arrest records wiped clean. This applies if your case was based on the old version of the handgun law that was in place before September 1, 2021.

To qualify, two things must be true. First, you were tried and found guilty of the crime you were arrested for. Second, the crime happened before September 1, 2021, under the old handgun law. If both of these apply to you, you have the right to ask a court to expunge, or erase, all records and files connected to that arrest.

This rule exists because Texas changed its gun laws after September 1, 2021, making it legal for most adults to carry a handgun without a license. Because of this change, the state allows people convicted under the old, stricter law to clear their records, since the same actions would no longer be considered a crime today.
