Art. 7.16 SUIT ON BOND

When someone breaks the terms of a bond that was set up under this chapter, the state can take legal action to forfeit it, meaning the person could lose the money or property tied to that bond. This lawsuit has to be filed in the same county where the bond was originally issued.

The case is handled by the government, not by a private person. It's brought by either the district attorney or the county attorney, and it's filed on behalf of the State of Texas, not in an individual's name.

This means if a bond gets forfeited, the local prosecutor's office in that specific county is responsible for pursuing the case in court. The person who signed the bond, or the person the bond was for, would then face this action locally rather than in another county or court system.
