Rule 411 Liability Insurance

Whether someone has liability insurance cannot be used to argue they were careless or did something wrong. For example, a lawyer cannot tell the jury that a driver had car insurance to suggest the driver was reckless, or that someone had no insurance to suggest they were careful.

However, insurance information can come up in court for other reasons. A judge might allow it to show that a witness has a personal stake in the outcome, or to help prove who owned or controlled something when that is being disputed.
