Rule 802 The Rule Against Hearsay

Hearsay is generally not allowed in court. Hearsay is when someone repeats what another person said outside of court, and that statement is used to prove something in the case.

There are exceptions, though. A law, the Texas Rules of Evidence, or other official court rules can allow hearsay to be used in certain situations. Many of those exceptions are found elsewhere in the rules.

If hearsay does get into court and nobody objects to it, the judge cannot later dismiss it just because it is hearsay. In other words, if the other side lets it in without a fight, that statement still counts as evidence.
