Rule 45 Review of judgments, orders, and decrees of court of appeals

If you lose your case in the Utah Court of Appeals and want the Utah Supreme Court to look at it, you cannot just file a regular appeal. Instead, you must ask the Supreme Court for permission to review the case. This is done by filing a document called a "petition for a writ of certiorari." This petition asks the Supreme Court to use its own judgment about whether the case deserves another look.

The rule also explains how the words "petition" and "petitioner" work in the related rules that follow (Rules 45 through 51). If someone files their own petition after another party already filed one, that response is called a "cross-petition," and the person who files it is a "cross-petitioner." Any time these rules mention a petition or petitioner, that also includes cross-petitions and cross-petitioners, unless a specific rule says something different.
