Rule 23 Disqualification of Circuit Court Judge

If you believe the judge assigned to your financial exploitation case can't be fair or has a conflict of interest, you can ask for that judge to be removed from the case. This process follows the same rules used in other West Virginia trial courts, found in Rule 17 of the Trial Court Rules.

Because financial exploitation cases often involve vulnerable people whose money or property is at risk, these disqualification requests can be handled quickly, even on an emergency basis. This means the court can act fast to appoint a new judge if needed, instead of making people wait through a slow, normal process. This helps make sure the case keeps moving and the person who may be a victim doesn't face unnecessary delays in getting help.
