Rule 2.1 Form of Complaints

If you want to file a complaint against a judge in West Virginia, you need to follow the format set by the Judicial Investigation Commission. The Commission gets to decide what that format looks like.

If someone other than the Office of Disciplinary Counsel or the Commission itself is filing the complaint, they may be required to put it in writing and sign it as true under oath. This means regular citizens who want to report a judge's conduct may need to submit a written, verified statement rather than just making a verbal complaint.

This rule basically sets up the ground rules for how complaints get started in the judicial discipline process.
