Rule 4.9 Response to Recommended Disposition

Once the Judicial Hearing Board recommends how a judge's case should be resolved, both sides get a chance to weigh in. The Office of Disciplinary Counsel and the judge each have 30 days from the date of the report to tell the Clerk of the Supreme Court of Appeals whether they agree or disagree with the recommendation.

This means neither side is stuck with the outcome right away. If they agree with what the Board recommended, they file their written consent. If they disagree, they file an objection instead. This step gives both parties a formal chance to accept the decision or push back on it before the case moves forward.
