Rule 3 Service of process

When you file a civil case in magistrate court, the other person (the defendant) has to be officially notified about the lawsuit. This notice comes in the form of a summons and a copy of the complaint you filed.

Magistrate court doesn't have its own separate process for delivering these documents. Instead, it follows the same rules used in the regular trial courts, found in Rule 4 of the standard Rules of Civil Procedure. This means the summons and complaint can be delivered by methods like certified mail, personal delivery by a sheriff or process server, or other approved ways depending on the situation.

The main point is that the defendant must actually receive proper legal notice before the case can move forward. Courts take this seriously because a person has the right to know they're being sued and to have a chance to respond before a judge makes any decisions in the case.
