Rule 15 Subpoena

If you need someone to testify in your case, or you need documents or physical evidence brought to court, you can get a subpoena. This is a legal order that tells a person they must show up to court or hand over specific paperwork or items.

In magistrate court, the clerk, deputy clerk, magistrate, or a magistrate assistant can issue these subpoenas for you. They follow the same steps used in circuit court, which is the rule that regular criminal courts in West Virginia use for subpoenas. This keeps the process consistent whether your case is in magistrate court or circuit court.
