Rule 16 Appeals

If you want to challenge a final decision in a minor guardianship case, the process depends on which court made the decision. If the case was decided in family court, you need to follow the same appeal steps used for other family court cases. These steps are laid out in the Rules of Practice and Procedure for Family Court.

If the case was decided in circuit court instead, you'll follow a different set of steps. These are found in the Rules of Appellate Procedure, which cover appeals to West Virginia's higher courts.

Basically, this rule doesn't create new appeal steps for guardianship cases. It just points you to the correct existing rules based on which court handled your case. Knowing which court issued your final order tells you exactly which appeal process to use.
