Rule 16.08 Abuse and Neglect Proceedings

When a child abuse or neglect case is filed in court, the law sets specific deadlines for how the case must move forward. These deadlines come from West Virginia's child abuse and neglect laws and the specific rules that courts follow for these types of cases. The goal is to make sure these cases don't drag on and that children and families get decisions in a timely way.

For tracking purposes, courts measure how long a case takes from start to finish. The clock starts when the petition (the initial court document that starts the case) is filed. The clock stops when the court makes its final decision, called a disposition order. Courts aim to complete this entire process within twelve months. This twelve month timeframe helps courts monitor whether cases are moving at an appropriate pace and helps identify cases that may need extra attention to keep them on track.
