Rule 26.01 Mass Litigation - Preamble

Some court cases involve a large number of people who have similar claims against the same defendant or defendants. Think of situations where many people were harmed by the same product, drug, or event. Handling each of these cases separately would take up a huge amount of court time and could lead to different judges making different decisions on the same basic issues.

To deal with this problem, West Virginia has set up a special system for these large, complex cases. This system is designed to make things run more smoothly and get cases resolved faster. A key part of this system is the Mass Litigation Panel, a group set up specifically to oversee these big cases.

If you're involved in a case that gets grouped with many similar claims, this means your case may be handled by this special panel instead of going through the regular court process. The goal is to save time, avoid conflicting rulings, and give everyone involved a fair and consistent way to get their case heard.
