Rule 36.02 Motions for an Extension of Time

If you need more time in a criminal case, you can't just get an agreement from the other side and call it done. You have to file an official motion with the court, along with an affidavit, explaining why you need the extension. The court will only grant more time if you show a good reason for it.

This means both sides can't simply agree between themselves to push back deadlines in a criminal case. Even if the prosecutor and defense attorney are fine with giving each other more time, that agreement doesn't count on its own. The judge has to review the request and decide if there's a real, valid reason to allow the extension.

This rule exists to keep criminal cases moving and prevent unnecessary delays. Courts want to make sure deadlines are taken seriously, especially in criminal matters where a person's freedom may be at stake. So if you're involved in a criminal case and need extra time for something like filing paperwork or preparing for a hearing, be ready to explain your reasoning to the court in writing.
