Rule 37.02 Motion for Speedy Trial

If you want to demand a speedy trial, you usually need to put it in writing. This request has to be its own separate document, not buried inside another filing. It must include the correct case caption and case number, and the attorney making the request has to sign and date it.

Once the written demand is ready, a copy has to go to the prosecutor's office in time for them to see it. The original also needs to be filed with the court clerk. When you file it, you must include proof that you actually sent a copy to the State's attorney, showing when and how it was delivered.

The only exception is if you ask for a speedy trial out loud in open court. In that case, you don't need the separate written document, since the judge and prosecutor already heard the request directly.
