Rule 41.01 Notice of Change of Plea Hearing

When both sides in a criminal case reach a plea deal, the lawyers need to tell the court right away. Once the court knows about the deal, it will schedule the change of plea hearing as soon as possible.

This rule also affects speedy trial rights. Normally, a defendant has the right to a trial within a certain amount of time. But once a plea agreement is reached, the clock on that speedy trial deadline pauses. Both sides are treated as having agreed to this pause, unless the court finds there's some unusual reason not to allow it.

In practical terms, this means agreeing to a plea deal temporarily gives up the strict time limits for going to trial. This gives the court and both sides room to schedule the hearing without worrying about running out of time under speedy trial rules.
