Rule 704 (Effective August 1, 2019.) Opinion on ultimate issue (Effective August 1, 2019.)

VII. Opinions and Expert Testimony

(a) In General — Not Automatically Objectionable. — An opinion is not objectionable just because it embraces an ultimate issue.

(b) Exception. — In a criminal case, an expert witness must not state an opinion about whether the defendant did or did not have a mental state or condition that constitutes an element of the crime charged. Nothing in this rule prohibits admission of testimony that would otherwise be admissible under Wyo. Stat. Ann. § 7-11-303 and § 7-11-304.
