Rule C Initial Use of Landowners’ Participation Agreements
Rule Text
(1) The ASG has used a document entitled “Landowners’ Agreement to Participate in Process in the High Court to Lease Land upon Terms to Be Negotiated by the Governor of American Samoa with Respect to Lease Agreement between National Park and Landowners” (“landowners’ participation agreement”) to authorize the Governor to act as the agent of the landowners in each village with lands within the Park in negotiating the lease agreement. The High Court will use the landowners’ participation agreements as a basis for identifying participating landowners in the rental assessment proceedings.
(2) As the first step in the rental assessment proceedings, and within 30 days after promulgation of these supplemental rules, the High Court, on its own motion, shall initiate and declare a formal proceeding, styled “National Park Rental Assessment Proceeding for the Village/County of __________.” The declaration shall set forth the process that shall be followed in the proceeding and shall be submitted, along with a blank form for certification of the proposed payees to receive rental compensation payments (“Certification”), to the village/county council. Effective October 18, 1993.
