Rule 26.1 Determination of Foreign Law

If a case involves a question about another country's laws, one side has to give the other side written notice ahead of time. This gives everyone a fair chance to prepare, instead of being surprised by a foreign law issue partway through the case.

When the judge has to figure out what a foreign country's law actually says, they aren't limited to only what the two sides hand them. The judge can look at outside sources, expert testimony, or other materials to get it right, even if neither side brought that information forward.

Finally, whatever the judge decides about the foreign law counts as a legal ruling, not a factual finding. This matters because legal rulings get reviewed differently on appeal than factual ones. It also means a jury doesn't decide what the foreign law means. That job belongs to the judge alone.
