Local Rule 4004-2 Closing Individual Chapter 11 Cases Prior to Discharge Closing Individual Chapter 11 Cases. In a Chapter 11 case involving an individual debtor, after the effective date of a confirmed Chapter 11 plan, the debtor may, upon motion and opportunity for hearing, close the Chapter 11 case; provided, however, that the debtor's case shall not be closed if any related adversary proceeding remains pending. Upon satisfaction of the requirements of 11 U.S.C. § 1141(d)(5), the debtor may move to reopen the Chapter 11 case and request entry of the discharge. If the debtor wishes to seek waiver of the reopening fee, the debtor should request that relief in the motion to reopen. The requirements of Local Rule 4002-1(d) shall be suspended while the debtor's case is closed.
