Rule 24.1 Constitutional Challenges to Statutes, Rules, and Ordinances A party who files a pleading, written motion, or other paper drawing into question the constitutionality of a federal or state statute or rule must promptly file and serve a notice under Federal Rule of Civil Procedure 5.1(a). A party who files a pleading, written motion, or other paper calling into question the constitutionality of a political subdivision's ordinance or rule must file a notice and serve it on the state attorney general, the state attorney with jurisdiction in the political subdivision's geographic area, and the attorney for the political subdivision.
