Rule 90.205 Denial of a request for judicial notice

When a judge decides not to take judicial notice of a fact, they must tell everyone involved as soon as possible. The judge also has to make an official record showing that the request was turned down.

Judicial notice is when a judge accepts a well-known or easily proven fact as true without requiring evidence. If a judge refuses to do this, lawyers need to know right away so they can plan how to prove that fact another way.
