Rule 90.207 Judicial notice by trial court in subsequent proceedings

If a judge says no to taking judicial notice of a fact during one part of a case, that decision is not final. Another court, or even the same court at a later stage, can still choose to officially recognize that fact.

This means a failed attempt to get a court to accept a fact as commonly known is not the end of the road. You can try again in later proceedings, as long as you follow the proper steps laid out in the Florida Evidence Code.
