Rule 90.508 Privileged matter disclosed under compulsion or without opportunity to claim privilege

If a court wrongly forces someone to reveal private, protected information, that information cannot be used against them later in the case. The law recognizes that the person did not willingly give up their right to keep that information private.

The same protection applies if someone shared protected information before they had a real chance to object. If you never got the opportunity to say "wait, that's privileged," the information still cannot be used against you.
