Rule 90.509 Application of privileged communication

If you had a private, protected conversation before July 1, 1979, the new evidence rules do not take away that protection. The older rules that applied when you had that conversation still cover it.

This means the date of the conversation matters. If it was privileged when it happened, it stays privileged, no matter what the newer rules say.
