Rule 6.310 Lesser Included Offenses

If you are charged with a criminal traffic offense, like reckless driving, the court cannot reduce it to a civil traffic ticket as a lesser charge. The two types of offenses are kept completely separate under Florida traffic law.

This matters because in some criminal cases, a judge or jury can find someone guilty of a smaller related charge instead of the main one. That option does not apply here. A civil traffic infraction, like a speeding ticket, can never be used as that smaller related charge in a criminal traffic case.
