Rule 4-208 Confidential Discipline; Effect in Event of Subsequent Discipline

If a lawyer gets confidential discipline for a past problem, that record normally stays private. But if the same lawyer later gets in trouble again and faces a new disciplinary case, that old confidential record no longer stays hidden.

In the new case, the State Bar's lawyers (the Office of the General Counsel) can bring up the earlier confidential discipline. They can use it to argue that the lawyer should face a harsher punishment this time around, since this isn't their first violation.

Basically, this rule means a lawyer's past discipline problems don't stay secret forever if they keep getting into trouble. A repeat pattern of misconduct can be used against them, even if the first offense was supposed to be confidential.
