Rule 4-211.1 Dismissal after Formal Complaint

Once a formal complaint has moved forward because the State Disciplinary Board found probable cause, the case can still be dropped later on. The Office of the General Counsel has the power to dismiss the case even after this point.

But they can't do it alone. They need approval first. This approval can come from either the Chair or Vice-Chair of the State Disciplinary Board, or from any three members of the Board agreeing together.

For someone facing a disciplinary complaint, this means the case isn't automatically locked in just because probable cause was found. There's still a path for the case to end early, but it requires sign-off from board leadership or a small group of board members to make sure the decision to drop the case is properly checked.
