§ 9-11-119 [Motion to Dismiss Form]

This rule gives a sample form for asking a court to throw out a lawsuit. It shows how a defendant (the person being sued) can officially tell the court that the plaintiff's complaint does not have enough legal grounds to move forward. The most common reason listed is that the complaint "fails to state a claim," which basically means even if everything in the lawsuit is true, it still does not add up to something the court can give relief for.

The form also includes space for other legal defenses a defendant might raise under a related rule (Code Section 9-11-12), so a defendant is not limited to just one reason for asking for dismissal. Along with the motion itself, the form includes a "Notice of Motion," which tells the other side when and where the court will hear arguments about the motion.

In simple terms, this is a template. It shows attorneys the proper format for filing a motion to dismiss and for letting the other party know a hearing is coming. It is not a rule about what happens in the case itself, but about how to correctly ask the court to consider dismissing it.
