§ 9-11-21 [Misjoinder and Severance of Parties]

If you named the wrong people in a lawsuit, or left someone out, the judge will not throw out your case because of that mistake. Instead, the court can add or remove people from the lawsuit at any point during the case.

Either side can ask the judge to add or drop a party, or the judge can decide to do it on their own. The court will set whatever conditions it thinks are fair when making that change.

If there are claims against one specific person that need to be handled separately, the judge can split those off into their own case. This keeps a naming mistake from ruining an otherwise valid lawsuit.
