§ 9-11-29 [Filing of Discovery Materials]

When two sides in a lawsuit agree on something in writing, they have some freedom to change how depositions and other discovery work. Discovery is the process where both sides gather information and evidence before trial.

For depositions, both sides can agree to hold them in ways that differ from the normal rules. They can choose a different person to run the deposition, pick a different time or place, or give shorter notice than usual. As long as both sides agree in writing, those depositions are treated just like any other deposition.

Both sides can also agree in writing to change the rules for other parts of discovery, like how they share documents or answer written questions. A judge can step in and require the parties to follow the standard rules if needed, but otherwise the agreement between the parties stands.
