§ 24-13-138 [Depositions by Party Agreement]

If both sides in a case agree, they can still take and use depositions even if the normal court rules would not allow it. A deposition is when someone answers questions under oath before the trial, either in person or in writing.

The judge must approve this agreement before it takes effect. As long as the court gives its okay, the parties have flexibility to work out deposition arrangements that fit their specific situation.
