§ 24-13-152 [Property Possession Immaterial to Proceedings]

When someone goes to court over property, it does not matter who is physically holding or controlling that property at the time. The case can still move forward regardless of who has possession.

A court case also will not be thrown out just because some of the people who might have a stake in the property cannot be found or identified. The proceedings can continue even if not every interested party is part of the case.
